Transfer of Ownership Information

I recently sold my interest in a well, what do I need to do now?

If you recently sold your Royalty Interest (RI), Working Interest (WI) or Overriding Royalty Interest (ORRI) please send a copy of the appropriate conveyance filed of record in each county in which the property is located. You may send the conveyance directly to:

My family is in the middle of estate proceedings, who do I contact, and what documentation is needed?

Whether there was a will, and the state in which the estate is being probated, affects the answer to this question. Below is a list of some common scenarios, but for specific situations please contact the Land Department at ownerrelations@eeronline.com or (432) 262-8998.

SCENARIO 1. Owner died with a will (testate) and probate proceedings are to be conducted in the same state in which the properties are located.

WHEN PROBATE IS COMPLETE, send the following information to the Land Department, 110 N. Marienfeld, Suite, 200, Midland, TX 79701:

  • Certified copy of Last Will and Testament
  • Order Admitting Will to Probate
  • Letters Testamentary
  • Final Decree of Distribution (if applicable)
  • Recorded conveyances (if applicable)
  • Copy of Death Certificates

SCENARIO 2. Owner died with a will (testate) and probate proceedings are to be conducted in a state other than the state in which the property is located.

WHEN PROBATE IS COMPLETE, send the following information to the Land Department, 110 N. Marienfeld, Suite, 200, Midland, TX 79701:

  • Documents of ancillary probate proceedings in all effected states (requirements vary according to individual state laws)
  • Recorded conveyances (if applicable)
  • Copy of Death Certificate.

SCENARIO 3. Owner died without a will (intestate)

Send the following information to the Land Department,

  • Letters of administration (if applicable)
  • Affidavit of Heirship (individual state laws of Descent and Distribution will apply as relevant)
  • Recorded conveyance (if applicable)
  • Copy of Death Certificate


There has been a change to the Trustee, what documentation is needed?

Send the Endeavor Land Department a copy of the recorded resignation of the present trustee and a copy of the recorded instrument whereby the successor trustee was appointed, and/or a copy of the Trust Agreement.


There has been a change of ownership due to a divorce. What is needed to update ownership information?

Please send the Endeavor Land Department a copy of the complete Divorce Decree including the Settlement Agreement. Also include the recorded conveyance if applicable.


What do I do when an Owner of a life estate passes away?

Send the land department a copy of the life tenant’s death certificate, and the names and addresses of the remaindermen.


A joint tenant passed away. How do I update ownership?

Send the land department a copy of the death certificate.


Do you have land you want to lease to Endeavor?

Owner Information and Changes

How do I change my name?

If your name has changed due to marriage, divorce, or adoption please send legal documentation proving the name change. Examples include a marriage certificate, divorce decree reinstating maiden name, etc.

 

How do I change my address?

Our Company or Corporation changed its name only. What documentation does Endeavor need?

Send the land department a copy of the Certificate of Name Change with the Tax ID.

 

Our company needs to notify Endeavor of a name change due to a recent merger. What documentation does Endeavor need?

Send the land department a copy of the Certificate of Merger with the Tax ID.

 

We appointed an Attorney-in-Fact.  How do we update our records?

Send the land department a copy of the recorded power of attorney.

 

A trust was just created. What do we do now?

Send the land department a copy of the Trust Agreement and appropriate recorded documents conveying the interest(s) to the Trust

 

Our trust was terminated. What does Endeavor need?

Send the land department a copy of the Dissolution of Trust and appropriate recorded conveyance to the trust beneficiary.

 

There has been a change to the Trustee. What documentation is needed?

Send the land department a copy of the recorded resignation of the present trustee and a copy of the recorded document whereby the successor trustee was appointed.


I’ve filed for Bankruptcy. What action do I need to take?

Chapter 11 Bankruptcy: For this option, Endeavor will require a plan of reorganization and order confirming the plan of reorganization.

Chapter 7 Bankruptcy: For this option, Endeavor will need a copy of the recorded conveyances as appropriate. For either option please send your documentation to the Endeavor Land Department

Revenue Information and Changes

Why didn’t I receive a revenue check?

Typically, most owners have a minimum suspense threshold of $100 and will only receive a check when production sales are $100 or more. Any unpaid royalties remain in suspense until the next release of minimum suspense or whenever production sales total $100 or more. Endeavor typically releases minimum suspense once each calendar year. However, under Section 91.402(f) of the Texas Natural Resource Code, owners may request a lower minimum suspense threshold (see code below).

Section 91.402(f) of TNRC: Payment may be remitted to a payee annually for the aggregate of up to 12 months’ accumulation of proceeds if the payor owes the payee a total amount of $100 or less for production from all oil or gas wells for which the payor must pay the payee.  However, the payor may hold accumulated proceeds of less than $10 until production ceases or the payor’s responsibility for making payment for production ceases, whichever occurs first.  On the written request of the payee, the payor shall remit payment of accumulated proceeds to the payee annually if the payor owes the payee less than $10.  On the written request of the payee, the payor shall remit payment of proceeds to the payee monthly if the payor owes the payee more than $25 but less than $100

  • If you’ve moved recently, we may not have your current address on file. Please complete an Owner Change of Address Form on the Owners Portal.
  • Our Land Department may not have received your signed Division Order. Please contact your Division Order Analyst in our Land Department. In some instances, your signed/returned Division Order may have been received after our check process was completed.
  • Our Land Department may not have your Tax ID/SSN on file. Please contact your Division Order Analyst in our Land Department.
  • If you receive ACH/Direct Deposit payments, your account may have been closed and/or you may not have notified us of your changed banking information. Please complete an updated ACH/Direct Deposit enrollment form on EnergyLink or submit a printable direct deposit form to Owner Relations at ownerrelations@eeronline.com.


If I need to change my address, what do I need to do?

Please complete an updated Owner Change of Address form on EnergyLink or submit a printable Owner Change of Address form to Owner Relations at ownerrelations@eeronline.com.


Can I retrieve my detail online?

Yes, both revenue payment detail and joint interest billing invoices are available to view/download on EnergyLink.


When is the revenue detail mailed?

Revenue detail is mailed with the revenue checks and is generally sent on the 25th of the month. You can also opt-out of receiving paper statements by registering on EnergyLink.

Starting in September 2020, when you register with EnergyLink, the default setting will be that revenue payment detail will no longer be mailed to you. However, you may request in a separate writing that Endeavor continue to mail you your payment details.


I did not receive my revenue check. What do I do?

After 10 business days, you may send your request in writing to ownerrelations@eeronline.com or by Fax to (863) 246-0114 to request a void and reissue on the next regular check run. To prevent lost checks Endeavor encourages direct deposit. To set up direct deposit, please log into EnergyLink and complete the ACH/Direct Deposit enrollment form.


What do I do if I would like my revenue check to be electronically deposited into my bank account?

To set up direct deposit, please log into EnergyLink and complete the ACH/Direct Deposit enrollment form. Please allow up to 60-90 days for processing.


What do I do if I change bank accounts for my electronically deposited revenue check?

Please login to EnergyLink to complete the ACH/Direct Deposit Enrollment and select Change for the Request Type so that we may process your account changes.


Will I still receive detail if I elect to have my revenue check electronically deposited?

You will continue to receive revenue payment detail by mail unless you register with EnergyLink.

If I want to see the production sales reported to the State of Texas, where would I look?

Please refer to the Railroad Commission of Texas Website at www.rrc.state.tx.us.


Is my revenue check still valid after six (6) months from the date of issue?

No, a check is voided after 6 months. If this has occurred please contact the Revenue Department to request a new check or verify if the non-deposited amount has been added to subsequent checks.


Can I receive my historical revenue detail electronically?

Historical revenue detail is available to view as well as download on EnergyLink.
